Additionally and according to the judgment, in order to successfully self-quarantine or self-isolate, a person requires access to a separate room where the person should self isolate.
NATIONAL NEWS – AfriForum has declared their latest court victory which allows Covid-19 patients to self isolate wherever they want, calling it “a big win for justice and freedom”.
The court victory was confirmed by the organisations head of policy and action, Ernst Roets, who tweeted images of pages from the judgment along with the caption: “BREAKING: AfriForum has just obtained a court order declaring that a person tested positive for Covid-19 may not be forced into a state quarantine facility if they are able and willing to self-isolate.”
Essentially, the judgment declares that from this point downwards, and as per an agreement between the parties involved in the case, Regulations 6 and 7 published by the department of cooperative governance and traditional affairs on 29 April 2020 in terms of section 27(2) of the Disaster Management Act can be interpreted to say that anyone who has tested positive for Covid-19 and is considered an active case or has come into contact with a confirmed case of Covid-19 “is only required to be quarantined or isolated at a state facility, or other designated quarantine site; when that person is unable to self-quarantine or self-isolate or refuses to do so, or violates the self-quarantine or self-isolation rules”.
Additionally and according to the judgment, in order to successfully self-quarantine or self-isolate, a person requires access to a separate room where the person should self isolate. No one else must sleep in or spend time in the designated self-isolation room.
Lastly, the order dictates that the person must be able to contact or return to a health facility if their condition worsens.
